While toplessness is allowed in NYC, i guess its not at the Empire State Building. The article doesn't say if they have a code of conduct or not.

Not sure how this could have really done "damage" to the reputation of the building though.

 

Guess Hank Jr was right, everybody sues over every little thing these days....

 

Interesting precedent though, we don't like a photo you took here, even though you commited no crime, therefore we sue you.

Technically, a photo where a location or property is recognizable should require a property release. I'm sure they don't care about the millions of photos taken there each year, but when one causes controversy, they can pull out the " you didn't obtain permission or sign a release" card.

Controversy or profitable...I'm sure they would do the same if that or another photograph might generate a reasonable profit...

frivilous lawsuits while others cant even access the courts for legitimate reasons , typical.
